1. Acceptance of Terms

By accessing or using RoJo ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service. These terms apply to all users including students, parents, teachers, and district administrators.

2. Description of Service

RoJo is an AI-powered math tutoring platform for students in grades 6–12. The Service provides personalized tutoring, progress tracking, wellbeing monitoring, and communication tools for students, parents, and educators.

3. User Accounts

You must provide accurate information when creating an account. You are responsible for maintaining the security of your account credentials. Teachers are responsible for the class codes they share. Parents are responsible for monitoring their child's use of the Service.

4. Acceptable Use

Users agree not to misuse the Service, attempt to bypass rate limits or security measures, use the Service for any unlawful purpose, or share account credentials with others. Students must use the Service for educational purposes only.

5. Homework Safeguard Policy

RoJo is designed to teach, not to complete homework for students. The Service includes built-in safeguards to prevent academic dishonesty. Attempting to circumvent these safeguards violates these Terms.

6. Wellbeing Monitoring

RoJo monitors student sessions for signs of emotional distress. By using the Service, you consent to this monitoring. Alerts may be sent to teachers and parents when concerning content is detected. In cases of immediate danger, appropriate authorities may be contacted.

7. FERPA Compliance

RoJo complies with the Family Educational Rights and Privacy Act (FERPA). Student educational records are protected. Parents have the right to access their child's data. Schools retain ownership of student data. We do not sell student data to third parties.

8. COPPA Compliance

For students under 13, a parent or guardian must create the account. By creating an account for a child under 13, you represent that you are the parent or legal guardian and consent to the collection and use of the child's information as described in our Privacy Policy.

9. Subscriptions and Payments

Paid subscriptions are billed monthly or annually. Subscriptions automatically renew unless cancelled. Refunds are not provided for partial billing periods. Prices are subject to change with 30 days notice. The free plan includes limited monthly questions.

10. Intellectual Property

RoJo and all associated content, features, and functionality are owned by RoJo Educational Consultants LLC. Users may not copy, modify, distribute, or create derivative works without written permission.

11. Disclaimer of Warranties

The Service is provided "as is" without warranties of any kind. RoJo does not guarantee that the Service will be error-free or uninterrupted. AI-generated content may occasionally contain errors. Always verify important information with a qualified teacher.

12. Limitation of Liability

RoJo Educational Consultants LLC shall not be liable for any indirect, incidental, or consequential damages arising from use of the Service. Our total liability shall not exceed the amount paid by you in the 12 months preceding the claim.

13. Changes to Terms

We may update these Terms at any time. Continued use of the Service after changes constitutes acceptance of the new Terms. We will notify users of significant changes via email.
